What determines if contract work with an employee is a salary offset , added to regular compensation, or should be done outside of work as an independent contract arrangement?

Salary Offset (the standard process when employees contract):
a) The work is on behalf of IMSA
b) The supervisor has released the employee from regular duties to enable work to be done in normal work hours
c) IMSA Intellectual Property rights are protected
d) Written approval is obtained from the employee supervisor to do the work
e) The scope of work is clearly defined

Incentive Compensation (added to salary):
Compensation incentive work (funds in addition to salary) is an option if
a) The work is deemed strategically important to IMSA
b) The employee holds unique and scarce expertise that is required to meet contract requirements
c) The work is done outside of work hours without decreasing job performance
d) IMSA Intellectual Property rights are protected
e) Written approval is obtained from the employee supervisor
f) The scope of work is clearly defined
